Terms of Service

Welcome to TextWhale. These Terms of Service ("Terms") govern your access to and use of our website and text transformation tools. By using TextWhale, you agree to be bound by these Terms.

TextWhale provides free online text transformation tools including but not limited to text formatting, encoding/decoding, case conversion, and text generation utilities. These services are provided "as is" and "as available" without warranties of any kind.

By using our services, you grant TextWhale a limited, non-exclusive license to process your content solely for the purpose of providing the requested text transformation services. We do not claim ownership of your content.

7. Intellectual Property Rights

All content, features, and functionality of TextWhale, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of TextWhale or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The TextWhale name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TextWhale. You must not use such marks without our prior written permission.

8. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TEXTWHALE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use the services at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTWHALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Any interruption or cessation of transmission to or from the services
  • Any bugs, viruses, or similar harmful code transmitted through the services
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

You agree to indemnify, defend, and hold harmless TextWhale and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the services or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the bottom of these Terms. Your continued use of the services after any modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the services will immediately cease.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TextWhale operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the services shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TextWhale regarding the use of our services and supersede all prior agreements and understandings.
